Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Givehood, including our mobile applications, our website at givehood.com, and related online services. By creating an account or using the app or website, you agree to these Terms and our Privacy Policy.

Agreement

If you do not agree, do not use Givehood. We may refuse service, suspend features, or close accounts that violate these Terms or create risk for others. You represent that you are old enough to enter a binding contract where you live and, where required, that you have authority to agree on behalf of yourself or your organization.

The service

Givehood provides a technology platform that helps users list, discover, and coordinate transfers of family and children’s items, including gifts, swaps, and paid sales as offered in the product. We are not the seller, buyer, donor, or recipient in user-to-user transactions unless we explicitly state otherwise. Features, availability, and regions may change; we may modify, suspend, or discontinue parts of the service with reasonable notice where practicable. Usage telemetry—including third-party analytics on native apps when enabled and first-party event logs stored in our database for signed-in users as described in our Privacy Policy—helps us operate and improve the service.

Accounts and security

You must provide accurate account information and keep it current. You are responsible for safeguarding your password and for all activity under your account. Notify us promptly at support@givehood.com if you believe your account is compromised. We may use email and in-app means to communicate with you about security and your account.

Listings, photos, and license

You are solely responsible for your listings, images, descriptions, and messages. You must have the right to give away, swap, or sell any item you post, and your content must comply with applicable laws (including consumer and tax rules for sales where they apply). Content must be truthful, not misleading, and appropriate for a family-oriented community. Listings may show approximate pickup or map information as you provide it. You grant Givehood a worldwide, non-exclusive, royalty-free license to host, reproduce, display, and distribute your user content solely to operate, promote, and improve the service and as required by law. You retain ownership of your content subject to this license.

Community rules

You agree not to harass, discriminate, defraud, spam, scrape, reverse engineer, or misuse the platform; not to circumvent security or any monetized feature we clearly label as requiring payment in the product; and not to list illegal, recalled, unsafe, counterfeit, or stolen goods. We may remove or restrict content, listings, or accounts, and cooperate with authorities when appropriate.

User transactions, meetups, and taxes

Arrangements to exchange items, pay outside the app, or meet in person are between you and other users. Givehood does not inspect items, verify identities beyond what the product provides, guarantee completion of a deal, or insure transactions. You are responsible for your own safety, for complying with local laws and regulations (including any obligations when selling goods), and for resolving disputes with other users. Fees you may pay to Givehood for optional platform features, if ever offered, are separate from user-to-user payments for items.

Privacy laws and accountability

Your personal information is handled under our Privacy Policy. Depending on where you live—including anywhere in Canada—you may have statutory privacy rights regarding collection, use, disclosure, retention, and accuracy of personal information. We describe subprocessors that typically store or process data on our behalf in the Privacy Policy so you can understand who holds information beyond Givehood itself. If you have concerns you cannot resolve with support@givehood.com, you may contact your local privacy regulator where applicable law permits.

Third-party services

The app and website rely on subprocessors such as Supabase (database, authentication, storage, optional Edge Functions), Firebase/Google when push or mobile analytics are enabled, Expo push infrastructure where used, Apple and Google distribution and maps/OAuth features, Vercel for the givehood.com marketing site, and retailer or affiliate sites you deliberately open. Each vendor processes information subject to its own terms and privacy notices; see our Privacy Policy for a fuller list of roles and storage responsibilities. We are not responsible for third-party services we do not control.

Disclaimers

Except where prohibited by law, the service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, Givehood and its affiliates, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the service. Our aggregate liability for claims arising out of or related to the service is limited to the greater of (a) the amounts you paid Givehood for the service in the twelve months before the claim or (b) fifty US dollars, except where applicable law does not allow such limitations.

Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Givehood and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your user content, your listings or transactions with other users, your violation of these Terms, or your violation of third-party rights or applicable law.

Termination

You may stop using Givehood at any time. We may suspend or terminate access to the service or your account if we reasonably believe you have violated these Terms, created risk or legal exposure, or if we discontinue the service. Provisions that by their nature should survive (including licenses to the extent needed to retain server copies for legal compliance, disclaimers, limitations, indemnity, and governing law) will survive termination.

Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms in the app and on givehood.com and revise the “Last updated” date. If a change is material, we will provide additional notice where required by law. Continued use after the effective date constitutes acceptance of the updated Terms, except where your express consent is required.

Governing law and disputes

Unless mandatory local consumer protection rules require otherwise, these Terms are governed by the laws of the jurisdiction in which Givehood’s operating entity is established, without regard to conflict-of-law principles. Courts in that jurisdiction (or another forum we specify in writing) have exclusive jurisdiction over disputes, subject to any right you may have to bring claims in your country of residence under mandatory law.
